Brexit and your IP rights – Are you Prepared?

The transition period for the UK leaving the EU ends on 31 December 2020.

From the 1st January 2021, EUTM (Trade Marks) and RCD (Community Designs) rights will no longer cover the UK.

On the 1st January 2021 the UKIPO has agreed to create a clone of the Registered EUTMs and Registered RCDs on the UK register, aka the corresponding mark.

Pending EUTMs and RCDs will not be cloned. However, you will have a 9 month window in which to file a UK national and claim priority from the EU right.

To assist our clients WebTMS will be making some automatic changes to your trade mark and designs module to reflect the BREXIT situation as far as your EU rights are concerned and it is really important you know what and when this is happening.
